LOS ANGELES (AP) – A jude has ruled that a lawsuit between former Beach Boys bandmates Mike Love and Al Jardine can proceed to a trial. Los Angeles Superior Court Judge James Dunn denied Love’s motion to rule immediately in his favor. Love is seeking two (m) million dollars in court costs and another one (m) million dollars in earnings he says Jardine wrongly was paid for using the Beach Boys name. Love says he’s the only one who has the rights to perform with that name. Federal courts ruled in 2003 Jardine must stop using the name. He had been performing under names like “Beach Boys Family and Friends,” “Al Jardine, Beach Boy,” and “Al Jardine of the Beach Boys.” A trial date has not been set.
